Article 1: Application of Terms
These terms and conditions define the conditions applicable between the developer of the smartphone application everyBUDDY (hereinafter referred to as "the Application") (hereinafter referred to as "the Developer") and the users of the Application (hereinafter referred to as "Users").
The Developer considers that Users have agreed to all the contents of these terms when they use the Application.
Article 2: Changes to the Terms
The Developer may change the contents of these terms at any time without obtaining the consent of Users, and Users shall accept this without objection.
When the Developer changes these terms, the Developer will notify Users of the changes by the method specified by the Developer.
The changes specified in the preceding paragraph shall take effect from the time the Developer makes the notification in accordance with the provisions of the preceding paragraph.
Users shall be deemed to have agreed to the changed terms without objection when they use the Application after the changes to these terms.
Article 3: Handling of Personal Information
The Developer shall handle Users' personal information appropriately based on the "Privacy Policy" separately established by the Developer.
Article 4: Handling of Content
All rights related to the content provided in the Application are held by the Developer or third parties with legitimate authority, and no rights are transferred or licensed to Users.
Article 5: Prohibited Actions
Users shall not engage in the following actions when using the Application:
Actions that infringe or may infringe on the copyrights, intellectual property rights, privacy rights, portrait rights, personal rights, or other rights of the Developer or third parties
Actions that violate or may violate laws and regulations
Actions that are contrary to public order and morals, or may be so
Actions that alter or delete information that can be used through the Application
Actions that interfere with or may interfere with the provision of the Application
Actions that use the Application in a manner or form that interferes with third-party communications, or may do so
Actions that interfere with or may interfere with the use or operation of the Developer's or third parties' equipment
Actions that cause or may cause disruption to computers or operations operated by the Developer or third parties, such as unauthorized access, cracking, attacks, or distribution/transmission of viruses
Actions to reverse engineer, decompile, or disassemble software information and copyrighted works included in the Application
Other actions that the Developer deems inappropriate
Article 6: Suspension of Service Use
The Developer may suspend the service use of a User without any notification, demand, or other procedures to the User if the User falls under any of the following:
The Developer shall not be obligated to disclose to the User the reason for suspending the User's service use under the provisions of this article.
When the User violates or may violate these terms
Other cases where the Developer deems it necessary
Article 7: User Responsibility
Users shall prepare all necessary communication devices, software, internet connections, and other necessary items for using the Application at their own expense.
If the Developer suffers direct or indirect damage related to the User's use of the Application (including cases where the Developer receives claims for damages from third parties), the User shall compensate the Developer for damages including litigation costs and attorney fees.
If lawsuits, claims, or other demands are made against the Developer or third parties in connection with the User's use of the Application, the User shall resolve these claims at their own expense and responsibility and indemnify the Developer or third parties.
Article 8: No Warranty
The Developer does not guarantee the accuracy, reliability, fitness for a particular purpose, or any other matters regarding the Application and the information provided to Users through the Application.
Article 9: Disclaimer
The Developer shall not be liable for any damages (including indirect damages and lost profits) incurred by Users and third parties in connection with the use, content changes, termination, interruption (including obstacles due to excessive access or other unexpected causes) of the Application, damages caused by suspending the User's service use in accordance with the provisions of Article 6, or any other damages related to the Application, regardless of whether such damages were foreseeable or not.
The provisions of the preceding paragraph shall not apply in cases where the Developer has intentional or gross negligence, or where the contract between the Developer and the User regarding the Application falls under a consumer contract under the Consumer Contract Act.
Article 10: Prohibition of Transfer of Rights and Obligations
Users shall not transfer, lend, or provide as collateral to third parties their rights and obligations or status as Users related to the use of the Application without obtaining prior written consent from the Developer.
Article 11: Contact Method
Contact from Users to the Developer regarding the Application shall be made through the inquiry form placed in the appropriate location on the website operated by the Developer or by the method specified by the Developer.
Article 12: Severability
Even if a part of these terms is determined to be invalid for any reason such as being illegal or unjust, the other parts of these terms shall continue to have full effect.
